原告梁国添,男,197521日出生,住所地佛山市南海区西樵镇民乐海边村二街53号。

委托代理人王河东,广东西江律师事务所律师。

被告张家活,男,195791日出生,住所地佛山市南海区西樵镇新河五七甲村88号。

本院受理原告梁国添诉被告张家活土地使用权纠纷一案后,被告张家活在提交答辩状期间对管辖权提出异议,认为被告的住所地在佛山市南海区,依照《中华人民共和国民事诉讼法》第二十二条第一款“对公民提起的民事诉讼,由被告住所地人民法院管辖……”的规定,本院对本案无管辖权,要求将该案移交有管辖权的佛山                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                        市南海区人民法院审理。

经审查,本院认为,原、被告因为土地使用权共有发生纠纷,双方发生使用权争议的土地位于肇庆市鼎湖区永安镇38区,根据《中华人民共和国民事诉讼法》第三十四条“因不动产纠纷提起的诉讼,由不动产所在地人民法院管辖”的规定,本案由本院专属管辖,被告张家活提出的管辖权异议理由不成立。依照《中华人民共和国民事诉讼法》第三十八条的规定,裁定如下:

驳回被告张家活对本案管辖权提出的异议。

如不服本裁定,可在裁定书送达之日起十日内,向本院递交上诉状,并按对方当事人的人数提出副本,上诉于广东省肇庆市中级人民法院。
